			</div><p>It is apprehended by experts that foreclosures will surge in Tennessee with homeowners running into default. Those who had shopped around for bargain foreclosed units did not have much to pick from in Green Hills or in Belle Meade because of only a handful of defaulters in 2011. But the picture is changing in Antioch and neighbouring regions – ideal for bargain house hunters in Middle Tennessee.</p>
<p>The temporary lull in foreclosures had lulled the local real estate market into complacency to think that the situation had improved. But in 2012 there is going to be another tidal wave of foreclosures as the banks unwind themselves after the February settlement with the state and federal governments.</p>
<p><img class="alignnone size-full wp-image-7021" title="foreclosure for sale" src="http://www.foreclosurerepos.com/blog/wp-content/uploads/2012/03/foreclosure-for-sale.jpg" alt="foreclosure for sale" width="200" height="163" />Last year nearly 11% of the sale in the residential market came from the distressed category – the drop being a third from 2010. The foreclosure rate at the national level was double the figures of Middle Tennessee as per RealtyTrac. Daren Blomquist of the firm said, “2011 was a fantasy land in that the market was not dealing with a lot of the distressed properties. We believe waves of foreclosures are coming. Not one wave, but a series of waves, which will probably put the lid on any home appreciation we have seen”.</p>
<p>After the robo-signing scandal the foreclosure rates in this area had gone down in the last few years. However the sale of single-family units have been increasing during the previous 8 months; the median price of residences stumbled in 2011 after gaining strength through most of the months of 2010.</p>
<p>Experts opine that foreclosure numbers will spike by 15% this current year, but it will be less than what was experienced five years previously at the time of the onset of the collapse of the property market. But the snowballing effect could push down prices further and weaken confidence of consumers.</p>
<p>Some of the working-class neighbourhoods in Middle Tennessee had seen a frenzy in building activity during the time of the housing bubble. The borrowers did not have the income to be current on their mortgages and were unable to withstand the blow of the housing crash opined David Penn of Middle Tennessee State  University. Those in the low-income group were the worst hit; they lacked even a reserve of 6 months reserve savings to re-build their lives.</p>

			</div><p>The foreclosure crisis is running deep. All those residing in Southern Oregon are well aware of this. Here, the landscape has drastically altered and there is not one resident who is not directly or indirectly affected by the crisis.</p>
<p>This is the fifth year that the foreclosure crisis is running and the problems related to it are persisting and have not changed. The troubled home owners are finding it difficult to contact lenders and talk with them while letting it drag on for months if not years without any tangible results.</p>
<p><img class="alignnone size-full wp-image-6933" title="book-law" src="http://www.foreclosurerepos.com/blog/wp-content/uploads/2012/02/book-law.jpg" alt="book law" width="200" height="150" />One of the victims is Beth Pederson, a resident of Klamath Falls. She has always been careful with her finances and cannot understand how she landed up in this mess. The threat of losing her house is looming large.</p>
<p>The most common stories are about borrowers overreaching themselves and buying houses well beyond their means. But neither Beth nor her home falls into that category. She had made a handsome down payment that was one-third of the price of the house. This left her with mortgage dues adding up to $70,000.</p>
<p>But because she missed out on one payment on the recommendation of her lender, she now owes to the bank (Bank of America) $137,000. There are many in the same boat. They have gone underwater with the worth of their property being less than what they owe. Beth has lost her equity for many years but thinks she is lucky to be still in her home. The entire system has betrayed thousands of others like Beth.</p>
<p>How did this happen? The mortgage services are generally one arm of the mega banks. They are not the owners of the banks that they service. The loans were bought by investors even before the ink was dry on the contract. The mortgage services were engaged to be the middlemen. It often makes financial sense to avoid foreclosure for those who invest as many recent studies have shown but for mortgage services it is otherwise; they gain by dragging on with foreclosure. Hence they avoid completing modification of loans on some plea or the others.</p>
<p>This has been prolonging the crisis in Oregon. Moreover, to make matters worse according to Oregon law, the services can keep on postponing foreclosures multiple times. They are not expected to complete modification talks prior to foreclosing. They are not mandated to even inform the homeowner of the new dates. This is at the root of the worsening of the crisis in Oregon. The foreclosure takes place without any monitoring by a neutral third eye and there are no conditions for mediation.</p>
<p>Oregon urgently requires protections that are put in place in other states of the USA.</p>

			</div><p>In Covington  City, King County of Washington State, the officials of code enforcement are finding it difficult to trace the owners or their representatives of abandoned foreclosed houses. It has become one of the top problems of the state.</p>
<p>Kevin Fagerstrom the supervisor of code enforcement informed that innumerable cases were pending against these deserted houses; some houses have been damaged badly by fires set off by squatters.</p>
<p><img class="alignnone size-full wp-image-6898" title="house-dollar-bills" src="http://www.foreclosurerepos.com/blog/wp-content/uploads/2012/02/house-dollar-bills.jpg" alt="house dollar bills" width="200" height="138" />The Homeowner’s Associations have never before faced so many delinquent dues. Some associations have sought bankruptcy protection said attorney Valerie Oman of Condominium Law Group. She said, “Nine times out of then when someone is losing their home, they stop paying their dues”.  It causes the dues of all others to shoot up. Moreover if the rate of delinquency in any development becomes too high then prospective buyers fail to get mortgage loans or financing.</p>
<p>Foreclosures mean high costs for the cities also. As per a report released by Joint  Center on Housing Studies of Harvard University, “A single mortgage failure, especially one that leaves the home vacant and unsecured, can impose tens of thousands of dollars of costs on cash-strapped public agencies”.</p>
<p>Nevada State has been worst hit by the foreclosure crisis. Its number of abandoned houses is three times that of King County. But the damage is relatively more localized. The areas that had witnessed building frenzy during the boom years are the worst affected. Banks are selling their distressed properties at heavy discounts and this is further pushing down prices in the property market.</p>
<p>Rainer Vista was a mega development in Covington that had bloomed during the booming years. Three years previously one credit unit foreclosed on 11 plots and seven houses. So far only five have been sold from these 18 units. Tom Tollen a realtor said that if the market has to return to normal then the bank-owned units would have to disappear.</p>
<p>In Crofton Hills troubles came to the surface from last July. John Wilson residing next to one of these abandoned units that he had seen squatters throwing out items from windows on the second floor. In 2003 Wilson and his spouse Mia had moved into quaint, new suburb – ideal for the middle-class. It had been built next to grazing grounds for cows. The atmosphere was safe with Mount  Rainer dominating the breathtaking scenery. But when the squatters took over, the couple started spending sleepless night. Loud parties continued till dawn. Wilson saw one of the hoodlums burning furniture in the back yard. Stoves and other appliances were openly pilfered.</p>

			</div><p>The chief economist of Moody’s Analytics, Mark Zandi estimated that small business unit owners took loans worth $75 billion for financing their enterprises in 2006. This has now tumbled to $20 billion and his prediction is that the figure will not improve noticeably in 2012.</p>
<p>Zandi himself took a business loan worth $40,000 in 1991 keeping as collateral his house in the suburbs of Philadelphia to start off a company that was the predecessor of Moody’s Analytics. Today others cannot easily follow his line of action. He commented, “That is one more reason to be nervous that small businesses won’t be the source of job growth they have in the past economic recoveries”.</p>
<p><img class="alignnone size-full wp-image-6825" title="mortgage-loan" src="http://www.foreclosurerepos.com/blog/wp-content/uploads/2012/02/mortgage-loan.jpg" alt="mortgage loan statement" width="200" height="149" />There is the possibility of the situation worsening. Those who started businesses contracted risky mortgages carrying high rate of interests and this is putting at risk not only their houses but also their businesses in the forthcoming years. Professor Samuel Bornstein of Kean University at New Jersey and Jung Song, a private consultant have conducted research on this issue. They have found that 3.7 million small entrepreneurs contracted risky loans like Option-ARM and Interest-Only mortgages. According to their findings over 500,00 are facing default risk during the coming couple of years as their monthly payments will shoot up after resetting of the loans; this will lead to payment of both interest as well as principal. Foreclosures will be inevitable.</p>
<p>One businessman exposed to this risk is Adrian Pelkus of San  Marcos in California. He used the equity on his residence to finance a minimum of six new enterprises during the previous fifteen years. He began his first company Squared Technologies by taking a loan in 1985 of $10,000 on his house.  But the housing bust has frustrated his endeavours.  In 2008 he planned a generation of power from the ocean waves. He patented this idea and produced a sample. His plan was to borrow from the equity on his home to do the laboratory testing and then sell the idea to investors. By 2009 the tumbling of property prices in California south had been so dramatic that he went underwater by over $100,000 on three properties he owned close to San Diego. He retreated from the wave power project, allowed patents to expire and focused on other ventures – electric cars and medical gadgets. He remains unsure about finding and without it cannot engage a dozen skilled engineers to make the start. Without home equity it is nearly impossible to take even the first step.</p>

			</div><p>Habitat has foreclosed on four residences. Carman Santone of Habitat (president of Trumbull County chapter of the organization) said that these were signs “of the times” America is passing through. He pointed out to the four homes Habitat was foreclosing upon. The occupants had been once eligible for these refurbished units. He said.”It’s becoming more and more of a problem. If we were a bank, they would have been out of there long ago”. Former president Jimmy Carter had a hand in making it famous. Santone reiterated that being a Christian group they always try to work with people and not against them.</p>
<p>Habitat combs through applications coming from the low-income group of the locality wanting to own a house. For those who qualify the mandate is that they have to put in 200 hours of volunteering work on the house that would later be their home or any other unit that Habitat was working on.</p>
<p><img class="alignnone size-full wp-image-6764" title="foreclosure" src="http://www.foreclosurerepos.com/blog/wp-content/uploads/2012/01/foreclosure1.jpg" alt="foreclosure sign" width="200" height="150" />In the majority of the instances the workers and craftsmen give their time after signing a promissory note that takes into account the expenses relating to materials plus tax on the property and insurance coverage costs.</p>
<p>Santone explained they have to run the show from a business standpoint. Without these payments they would not be able to start off on the next house. Sometimes Habitat stumbles paying for taxes and the insurance coverage and then they find their funds running dry.</p>
<p>Earlier in January foreclosure action was started against the four units said attorney Gil Rieger who is also a member of the Habitat board and had once been engaged in a project of Habitat in Mongolia. Rieger deals with the legal work free but he is aware of how lack of regular monthly payments “negatively impacts on Habitat’s mission”. He thought it to be a shame that the house owners sometimes totally ignore them. Although the loans do not carry any interest these have to be returned.</p>
<p>Reiger said they may soon have to file another foreclosure.</p>
<p>In one of the first four cases Habitat has had talks with a woman whose house is on Kenmore   Avenue who seems to be “coming around” and manage the monthly payment of $425 she has to give to Habitat.</p>
<p>Another loan taker living in Jackson Street had reached the same type of agreement with Habitat in 2009 March. She had promised to pay per month $164 plus dues on insurance and taxes.</p>
<p>In Oak   street another house was priced at only $18,720 and for this the occupant had to pay per month $199 – the amount being inclusive of insurance and taxes.</p>
<p>Until this sudden spate of four foreclosures Habitat had filed only one foreclosure in 2009, 2004, 2002 1998 and 1995.</p>

			</div><p>A study on two cities of Southern  California has shown that while foreclosures gobbled up some of the cities, others were spared. The tale of two cities highlights this trend. One weathered the storm with a couple of scratches but the other was battered and bruised.</p>
<p>Santa   Paula is an oil town having a place in history. In 2000 it was encircled with fruit bearing orchards. The residents numbered 29,000 enjoying a median income per family of $42,000. When the sub-prime crisis burst upon the scene in the “Citrus Capital of the World” 16 out of a cluster of 1,000 houses were foreclosed – the number being far below America’s average of 22 out of a cluster of 1,000 houses.</p>
<p><img class="alignnone size-full wp-image-6721" title="foreclosures-crisis" src="http://www.foreclosurerepos.com/blog/wp-content/uploads/2012/01/foreclosures-crisis.jpg" alt="home for sale sign" width="200" height="153" />Lake Elsinore is another historical town, very similar to Santa   Paula as regards size, income of families as in 2000. Today it is noted for its lake – the freshwater body being the biggest in the area, its shopping centres and its casino that is “California’s Friendliest Cardroom”. Foreclosures are high with 86 houses per a clutch of 1,000 being in the dreaded zone of foreclosure since the bursting of the bubble.</p>
<p>Political scientist Garrett Glasgow of Santa Barbara (University of California) said that the key factor is that Santa Paula followed policies of slow growth that put brakes on rampant construction of residential units; on the other hand Lake  Elsinore courted growth aggressively. From 2000 till 2008 Lake Elsinore ranked 12<sup>th</sup> among the fastest growing cities in California. The slogan of the city was “Dream Extreme”.</p>
<p>This pattern has been again and again replicated through the entire California  State as per a study done recently by Urban Affairs Review. The authors were Garrett Glasgow together with Paul Lewis (Arizona State University) and Max Neiman (University  of California). The stronger the anti-housing growth policy of the city council, the less was the number of foreclosures ten years afterwards.</p>
<p>The study indicates a view contrary to that held by the prevailing scholars regarding public policy. It has been said that the cities were swept away without having any say by bigger waves. But the authors noted, “Although the foreclosure crisis was driven by national and global forces, more cautious local government policy approaches to residential growth appeared to moderate the damage …One might claim that if more cities had made an effort to manage growth, then   the housing meltdown might have been significantly less burdensome”.</p>

			</div><p>Perched on bank rooftop demonstrators protest against foreclosure in the Mission District of San Francisco. Six persons clambered on to the rooftop of Wells Fargo around noon while nearly 200 activists crowded the streets near the bank. After ten minute later the firefighting force put up a ladder but till 12.35 pm none had climbed it.</p>
<p>The events were being observed by a scattering of police personnel from the streets and the sidewalks. The police declared that on their part no arrests would be made until and unless the bank asked them to take action.</p>
<p><img class="alignnone size-full wp-image-6710" title="bank" src="http://www.foreclosurerepos.com/blog/wp-content/uploads/2012/01/bank.jpg" alt="bank" width="200" height="113" />The activists chanted, “What do we want? No evictions and foreclosures for profit. They take our roof; we take their roof”! By demonstrating on the roof the protestors tried to drive home the message that the banks were taking away from the people the very basic symbol of living – the roof above their heads.</p>
<p>Some of the demonstrators held aloft signs that read, “Bank: No more evictions and foreclosures for profit”.</p>
<p>The demonstrators did not disrupt the traffic and the buses plied as usual. Life flowed on without interruption.</p>
<p>On Saturday morning (14<sup>th</sup> January) a statement was released by the organizing group – Occupy SF Housing. It said that they were “targeting people for predatory equity scams, Ellis Act evictions or immoral home loans – can no longer be tolerated”.</p>
<p>The coalition of Occupy SF Housing comprises of other groups – Occupy San Francisco, Housing Rights Committee of San Francisco, Tenants Union and other community organizations apart from individuals. The coalition declared that their target was to prevent the banks from evicting the tenants and the house owners using the foreclosure process.</p>
<p>Ted Guillicksen, a member of San Francisco Tenants Union said that everyone knows how the mega banks have wrongly been throwing out house owners. But less known is how these banks are also throwing out tenants by teaming up with the investors and speculators who are buying up apartments and building so as to increase the rents of all the tenants or to sell the houses they have acquired or are taking over as profitable condos.</p>
<p>The organizers of the event said that the protests on 14<sup>th</sup> January, Saturday was only an introductory move for a bigger demonstration that is aiming to close down the financial district of San Francisco.</p>

			</div><p>The cloud over attorney general of Florida Pam Bondi, regarding firing of two officers investigating foreclosures cleared as per a report submitted by Inspector General. Theresa Edwards, formerly assistant attorney general and her colleague named June Clarkson were investigating activities of the biggest foreclosure legal firms in Florida. The previous attorney general, Bill McCollum had started the investigations back in 2010, hunting for evidence to prove that these firms doctored court documents to expedite the foreclosures.</p>
<p>Bondi, a month after becoming Attorney General, demanded the “forced resignation” of Edwards and Clarkson according to the report of Neal Luczynski, the Inspector General of Department of Financial Services.</p>
<p><img class="alignnone size-full wp-image-6693" title="foreclosure-for-sale" src="http://www.foreclosurerepos.com/blog/wp-content/uploads/2012/01/foreclosure-for-sale.jpg" alt="foreclosure for sale sign" width="200" height="163" />The report composed of 84 pages. It noted the allegations made by the two that pursuance of their investigations of the “foreclosure mills” were discouraged and that there were political considerations behind their termination. But the bosses in interviews alleged the work of the two was sloppy and for this repeated warnings had been given. Their approach in dealing with the legal firms lacked professionalism.</p>
<p>Last December the Clarkson together with Edwards submitted a Power Point presentation on investigation of Lender Processing Services that had been done during the tenure of McCollum. LPS based in Jacksonville had inked a consent-order with Federal Reserve last April promising it would rectify the defective documents.</p>
<p>In the report Lucznksi stated, “Clarkson indicated the reason there was the issue with the Power Point presentation was because the counsel for LPS went to Tallahassee and ‘got their ear’.</p>
<p>Richard Lawson director of Division of Economic Crimes (A.G office) noted that in the A.G. office many were aware with the “unfair aggressiveness’ of Clarkson and Edwards. He was talking to Luczynski. Lawson was also concerned that the two were conducing open discussion with external parties – specifically lawyers dealing with foreclosure defense cases.</p>
<p>On 7<sup>th</sup> April Lawson contacted his superiors over the Power Point issue wanting the dismissal of the two. Also involved were investigations pertaining to other firms like that of Stern.</p>
<p>Lawson alleged that the two were dealing with massive number of cases without any method –  no stamping of dates or indexing. The files were disorganized and would require reopening by any fresh investigator.</p>
<p>However in August Edwards told Luczynski, “If you look anywhere you’re gonna find out they haven’t done one damn thing on these investigations since we left that office”.</p>
<p>Luczynski ruled that in the final count the firings did not involve violation of either the law or any policy. They were fired because of “poor judgment and lack of independent investigation on high-profile foreclosure mill cases”.</p>

It has spelt tremendous relief for Thomas, aged thirty two, working as the manager of a restaurant.<br />
But there are many others who are not as lucky as Thomas. It is apprehended that the lenders will take recourse to a flood of legal suits against the borrowers of mortgage loans within the forthcoming years to recover the losses they suffered when foreclosure or short sale amount failed to cover the amount due to them.  Professor Frank Alexander of Emory University, Atlanta fears that the problem will be dramatic “because the borrowers will not know it’s coming.”</p>

The lenders would have a free hand to add frills to the wages and lay their claws on the assets of the previous borrowers.</p>
<p>Prior to the housing crisis very few lenders took recourse to this step. At that time foreclosures and or short sales were of very rare occurrence; neither did the borrowers have enough assets that were worth chasing. But in the days following the housing zoom that caused millionaire investors to mushroom overnight, defaulting became common for borrowers sitting on handsome assets.<br />
In the next wave of the housing drama being staged those who are most at risk from being slapped with legal suits are furious homeowners who damage the properties they lose or walk away from them for having gone underwater. In both instances the banks are anxious to discourage them from such destructive behaviour.</p>
<p>Out of ten borrowers four have said they would think about walking away from underwater properties according Trulia as well as RealtyTrac.</p>

			</div><p>The Occupy Wall Street rally protesting against foreclosures and related issues is now joined by homeless advocates. As per Rhode Island Coalition for the Homeless nearly 4,400 people of the state were homeless in 2010. Last September’s counting found about 200 people roughing it out under the open skies in the streets. The number is on the conservative side because the count took place only on one night and many persons could have escaped notice.</p>
<p>The sagging economy of the state is partly responsible for this increase in numbers coupled with persisting unemployment hovering around double digits.</p>
<p><img class="alignnone size-full wp-image-6582" title="protestors" src="http://www.foreclosurerepos.com/blog/wp-content/uploads/2011/12/protestors.jpg" alt="protestors" width="200" height="128" />Jim Ryczek of Rhode Island Coalition for the Homeless (executive director) one of the organizers of the rally said, “The long and the short of it is we’re in a dire situation right now, because we’ve lost so much funding for homeless prevention and affordable housing at a time when the number of people coming into the homeless system has risen year after year after year”.</p>
<p>The idea behind the event is to pull attention to a problem that has become the forefront issue of the OWS movement – foreclosures. In New England the highest foreclosure rate is in Rhode Island; it is also among the worst hit regions of the country as per Housing Works, Rhode Island.</p>
<p>Approximately one out of ten households has either been foreclosed upon or is seriously delinquent. Mike McCarthy, one of the activists from Providence explained talks could run along whole day about bringing introducing significant economic reforms; but what the Occupy movement has done is to bring the foreclosure issue right in front – something that cannot be postponed any longer.</p>
<p>The members of Occupy have worked in tandem with Rhode Island Homeless Advocacy Project to assist those out in the park – were there much before the movement set up their camps. The two signature issues of the Occupy movement became homelessness and housing. McCarthy explained that by joining forces the movement will get extra punch to take home the message of bringing about urgent changes in the law.</p>
<p>Another group named Direct Action for Rights and Equality will be putting pressure on the General Assembly to give the green signal to a bill named Right to Rent. It would stop former house owners from being evicted by allowing them to become the renters of the lenders and stay on in their homes.</p>
