Foreclosure Bills May be of Assistance to Tenants in Nevada

The foreclosure bills being worked upon by the lawmakers may be of assistance to the tenants in Nevada. The bill also takes under its ambit problems related to healthcare and the problems of house owners. The worst sufferers have been the tenants of foreclosed houses who are being victimized for absolutely no fault of theirs.

The bill will make it compulsory for the lenders to notify the renters that the property is being foreclosed upon. The renters will be awarded 60 days to vacate the premises. Lawmakers have heard many complaints that often the renters are not notified and this results in their being asked to leave within few hours.

Another bill states that financial bodies drafting mortgage agreements will have to include clauses that specifies the value of the units and the loan terms in a simple language understandable to all. Hitherto the complain had been that this lack of transparency has had catastrophic impact on the borrowers who were unaware of what actually they were inking.

The Assembly Commerce and Labor Committee has sponsored AB 140. It will provide protection to the tenants of foreclosed units by making it compulsory for the banks and the landlords to notify the occupants that the unit is being foreclosed upon.

AB51 that is sponsored by Assemblyman Conklin demands that the lenders state the terms of the some non-traditional mortgages in simple plain terms – especially the point about future escalation of monthly payments.

Senator Mike Schneider has sponsored BDR-795. It requires institutions that are in possession of foreclosed houses to maintain and look after these as per HOA standards. In places where HOA standards are absent usual nuisance standards have to be maintained.

AB149 Sponsored by Speaker Barbara Buckley states that the mediation between the lenders and borrowers must pursue a line of good faith. It provides both parties a neutral platform from which negotiations can be carried out. The operations would come into force across the state with the assistance of senior judges and other members of the judiciary.

SB128, sponsored by Senator David Parks, states that foreclosure sales are to be recorded in a timely manner with the county recorder. This is of help when the question arises of tracking the owner.

AB152 sponsored by Conklin stipulates that foreclosure consultants and loan modification consultants must have extra licence for doing the work. It is hoped that this will prevent scams.
