A Mistake Leads to Foreclosure and Sale of Family Home in South Florida

A family in South Florida got the shock of their lives when they returned home to discover they were no longer owners of the house that till the morning was their home. It was by mistake sold off at a foreclosure.

On the night of Wednesday 12th August Anna Ramirez together with her husband and young nephew were thrown out of their home in Homestead by the new owner even though the family did not know anything about it.

It was true that their lender had begun foreclosure proceedings against them but thing came to a stop when loan modification talks started. But the relevant papers were not filed in the court at Miami Dade and the foreclosure proceedings continued as usual.

Thanks to the clerical error the buyer completed the purchase and Anna Ramirez and her family was told to leave. She desperately tried to show the officers who came to enforce the eviction instructions about the order of the judge but even then they were given the boot.

Ramirez worked as a cook in a Mexican eatery. She felt terribly and kept on crying throughout Thursday. It was only on the following day that the trauma ended with the mistake being pointed out to the judge.

Ramirez and her spouse lagged behind in the mortgage payments of $2,159 for a loan they had taken on their house. It was her parents who had bought this house in the suburbs of Miami for $260,000 three years previously. The unit consists of three bedrooms and 2 toilets. It was the responsibility of the Ramirez couple to foot the mortgage bills.

JP Morgan Chase began foreclosing and the home was auctioned off on 10th June for $87,000. But one week later the parents persuaded the judge to reverse the sale. The judge ordered both parties to negotiate a work out plan.

It was done and the monthly payment was reduced by $600. But the clerk of the court forgot to inform the buyer who appeared with police help on 12th August to take possession of the house. But the following day the court asked them to go back home!

The court documents show that the judge had given the clerk immediate orders to rectify the error. Nancy Norris speaking on behalf of Chase said there was “miscommunication” emanating from a clerical error.
