Foreclosures: Californian Democrates Vociferous On Foreclosures

Governor Schwarzenegger was pressurized by Democrats to summon a special legislative session to discuss rising foreclosures. Speaker Nunez said that foreclosures are a greater threat then water shortages and health reforms – these being the other topics scheduled for debate. It is an immediate problem – the greatest shaking the country and the state.

California ranks second after Nevada in foreclosure rankings with 50,000 filings in October. The ratio here is 1:258. The national proportion is 1:555 in October. These foreclosures indicate the alarming depression in the real estate market following sharply on the heels of the recent ballooning. It is telling on less tax collection by the state revenue department. The entire economy is affected with an anticipatory calculation of $10 billion deficit in the budget over the following two fiscal years. All round it can cost the local bodies $4 billion in revenue loss.

A new bill is being planned to be introduced that would ban penalties on repayments, increase the powers of the state to over view the activities of the lenders and expect the latter to deal in a reasonable manner with delinquent mortgages. Lenders would have to send borrowers a list of legal rights. Moreover the lenders would have to employ regular ombudsmen to see to complaints in a positive proactive manner. Certain kinds of loans and mortgage fees would be reined in. Private community bodies helping troubled house owners would be encouraged financially to increase the number of counselors. The bill could to an Assembly Committee the following week if the Governor summoned the special session. It could then be passed by the middle of December and reach the Governor’s desk before the end of the year.

The Mortgage Bankers Association of California supported foreclosure preventive measures being taken but with a note of warning to the Legislature. The latter should not over reach itself to block certain loans that ordinarily would help people own houses of their own. But waiting for the regular Assembly session of January could well postpone matters for months. On the other hand a special session would upset the vacation programmes of Republicans. However since the Democrats are in control of both houses the bill could be passed without the Republicans by a simple majority. Senate minority leader Ackerman thinks that it is a threat to bypass the Republicans – a publicity stunt to gain laurels.
